This website, theweg.org.uk, is operated by Worcester Environmental Group, also known as The WEG or WEG. Worcester Environmental Group is a Charitable Incorporated Organisation registered in England and Wales under charity number 1193048.

In these terms, “WEG”, “we”, “us” and “our” mean Worcester Environmental Group.

2. Acceptance of these terms

By accessing or using this website, you agree to these terms. If you do not agree, please stop using the website. Additional terms may apply to particular events, activities, volunteering opportunities, purchases or services. Where additional terms are provided, they apply alongside these terms.

3. Information on this website

We aim to keep website information accurate and reasonably up to date, but we do not guarantee that all content is complete, accurate or current. Website content is provided for general information and does not constitute legal, financial, medical, ecological, health and safety or other professional advice.

Information about routes, paths, green spaces, wildlife sites, events and outdoor activities may be affected by weather, land conditions, access restrictions, maintenance work and other matters outside our control. Users are responsible for checking current conditions, following signs and restrictions, using suitable clothing and equipment, and taking reasonable care for their own safety.

4. Donations

4.1 Nature of donations

A payment made through a donation facility on this website is a voluntary gift to WEG. It is not payment for goods or services and does not create a contract requiring WEG to provide the donor with any particular benefit, service or outcome.

Unless WEG expressly agrees otherwise in writing before accepting a donation, every donation made through this website is accepted as an unrestricted donation.

4.2 Unrestricted use

An unrestricted donation may be used by WEG's trustees for any of WEG's charitable purposes and activities, according to the charity's priorities and the trustees' assessment of how the funds can best be used.

The donor does not acquire any right to direct or control WEG's use of the donation.
A message, request or stated preference submitted with a donation is not binding on WEG.
WEG may allocate or reallocate unrestricted funds between projects, activities, core
costs, administration, fundraising, reserves and other charitable expenditure.
Decisions about the application of charitable funds remain with WEG's trustees.

4.3 Conditional or restricted offers

A person wishing to offer money subject to a condition or restriction must contact WEG before making payment. WEG is not obliged to accept a restricted or conditional donation. No restriction or condition will apply unless it has been expressly agreed in writing by a person authorised by WEG before payment is made.

4.4 Appeals and project descriptions

WEG may explain that donations will support a project, activity or area of work. Unless the appeal expressly states that funds are legally restricted to that purpose, the description indicates WEG's current intention only and the donation remains unrestricted.

Where WEG intentionally runs a restricted appeal, the appeal will clearly say so and will explain what may happen if the appeal raises more or less than required, or if the stated purpose cannot be carried out.

4.5 Authority to donate

By making a donation, the donor confirms that:

they are authorised to use the selected payment method;
the money belongs to them or they have the owner's authority to donate it;
the donation and the source of funds are lawful;
the donation is not connected with fraud, money laundering, terrorist financing or other unlawful activity; and
the information supplied is accurate.

A person under 18 should donate only with the knowledge and permission of a parent or guardian.

4.6 Payment processing

Online payments are processed using Wix Payments and may involve banks, card schemes and other payment-service providers. WEG does not normally receive or retain full payment-card details. A donation is complete only when it has been authorised and successfully processed.

WEG is not responsible for a payment being refused, delayed, reversed or cancelled by a bank, card issuer, card scheme, Wix or another payment provider.

4.7 Charges

Payment-processing and fundraising costs may be deducted before the net proceeds become available to WEG. Unless stated otherwise, the amount entered by the donor is the total amount charged by WEG. The donor remains responsible for any separate bank, card or foreign-exchange charges.

4.8 Refunds

Donations are normally final and non-refundable because, once received, they become charitable funds which WEG must apply in accordance with its charitable purposes and legal duties.

A change of mind, disagreement with a decision made by WEG, or a later request to redirect an unrestricted donation will not normally justify a refund.

WEG may consider a refund where:

a duplicate payment was made accidentally;
an incorrect amount was entered because of a genuine payment error;
the payment was made without the account holder's authority;
there is evidence of fraud or unlawful activity;
the donor was unable to make an informed decision at the time of donating;
WEG is legally required to return the money; or
the trustees decide that exceptional circumstances justify a return and that WEG has lawful authority to make it.

Requests should be sent promptly to info@theweg.org.uk and should include the donor's name, donation date, amount, transaction reference and an explanation. A request does not guarantee a refund. Any approved refund will normally be returned to the original payment method.

Nothing in these terms excludes a right that cannot lawfully be excluded.

4.9 Refusing, investigating or returning donations

WEG may refuse, suspend, investigate or return a donation where the trustees consider this lawful and in the charity's best interests. This may include suspected illegality, concerns about the source of funds, attempts to impose unacceptable conditions, significant reputational or safeguarding risk, administrative error or other exceptional circumstances.

WEG may carry out checks proportionate to the size and nature of a donation and may request information about the donor or source of funds.

4.10 Receipts and Gift Aid

A payment confirmation or receipt may be sent by WEG or its payment provider. A receipt confirms payment only and does not itself confirm eligibility for Gift Aid or any other tax relief.

Where WEG offers Gift Aid, it may claim Gift Aid only when the donor meets the legal conditions and supplies a valid declaration. The donor must tell WEG if circumstances change so that the declaration is no longer valid. Gift Aid attached to an unrestricted donation will also be treated as unrestricted.

5. Fundraising conduct and complaints

WEG aims to fundraise honestly, fairly and responsibly and to enable donors to make informed decisions. Questions, concerns or complaints about a donation or fundraising should be sent to info@theweg.org.uk or to WEG's registered address.

Please include relevant dates, amounts, transaction references and a description of the concern. WEG will acknowledge, investigate and respond within a reasonable period and will explain any available external escalation route where applicable.

6. Events, volunteering and outdoor activities

Information about events and volunteering may change or be withdrawn. Participation may be subject to separate instructions, risk assessments, consent requirements, eligibility criteria or event terms.

Participants must follow reasonable instructions from WEG representatives, landowners and event organisers.
Participants are responsible for deciding whether an activity is suitable for them and for bringing appropriate clothing, footwear and equipment.
Parents and guardians remain responsible for children or dependants in their care unless WEG expressly agrees otherwise.
WEG may refuse or end participation where reasonably necessary to protect people, wildlife, property, the environment or the proper conduct of the activity.

7. Acceptable use

You must not use this website:

unlawfully, fraudulently or in a way that infringes another person's rights;
to damage, disrupt or compromise the website, its security or associated systems;
to introduce viruses, malicious code or harmful material;
to obtain unauthorised access or collect information without lawful authority;
to impersonate WEG or falsely suggest WEG's endorsement; or
to transmit material that is unlawful, threatening, abusive, defamatory, discriminatory, obscene or harmful.

WEG may restrict access where it reasonably believes these terms have been breached or the website or its users are at risk.

8. Intellectual property

Unless stated otherwise, website text, branding, logos, graphics, photographs, videos, maps, documents and design are owned by WEG or used with permission.

Reasonable extracts may be viewed, downloaded or printed for personal, educational and non-commercial use, provided the material is not misleadingly altered, WEG is appropriately acknowledged and all notices are retained.

Written permission is required before using WEG's name or logo, republishing substantial material, or reproducing content for commercial purposes. Third-party material may be subject to separate rights.

9. Material submitted to WEG

Where a person submits photographs, comments, reports, suggestions or other material, they confirm they have the right to provide it, that it is lawful and that any necessary permissions have been obtained.

Unless agreed otherwise, the person grants WEG a non-exclusive, royalty-free permission to use, reproduce and adapt the material for WEG's charitable administration, communications and promotion. A person should tell WEG when submitting material if they do not want it published or credited.

10. Third-party links and services

Links to third-party websites, maps, social networks, payment services or resources are provided for convenience. Unless expressly stated, a link does not mean that WEG endorses or controls the third party. WEG is not responsible for third-party availability, accuracy, security, accessibility, terms, privacy practices or content.

11. Website availability and security

WEG does not guarantee that the website will always be available, uninterrupted, secure or free from errors or harmful material. WEG may suspend, withdraw, restrict or change all or part of the website. Users are responsible for protecting their own devices, accounts and data.

12. Liability

Nothing in these terms excludes or limits liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that:

WEG is not responsible for loss arising solely from reliance on general website information;
WEG is not responsible for loss caused by third-party services, outages, malicious software or circumstances outside its reasonable control;
WEG is not responsible for indirect or consequential loss; and
for business or commercial users, WEG is not liable for loss of profit, revenue, opportunity, savings, goodwill or data.

13. Privacy and cookies

WEG's Privacy Notice explains how personal information is handled. The Cookie Notice explains how cookies and similar technologies are used. These documents form part of the information governing use of the website.

14. Changes, severability and waiver

WEG may update these terms to reflect changes to the website, activities, payment arrangements, fundraising practice or law. The date at the top shows the latest update. If any provision is unlawful or unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision does not waive WEG's right to enforce it later.

15. Governing law

These terms and any dispute or claim arising from them are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except where applicable law gives a consumer the right to bring proceedings elsewhere.
